Seasonal Bulk Storage Contract Terms
This agreement is made and entered into on the date first shown above by and between Tenant and Lessor. Tenant and Lessor agree:
The Premises. Lessor hereby leases to Tenant interior space (called the “premises”) and located in the Storage52 LLC building in the Village of Eagle, Wisconsin.
Term of Lease and Rent. Tenant shall be entitled to store their property in the premises for seasonal rate shown in Lease Summary beginning on the Term Start Date and Term Ending Date shown in Lease Summary above. The rent shall be payable by Tenant to Lessor on the Date of Lease. This lease shall be deemed expired on Term Ending Date shown in Lease Summary above.
Non-payment of Rent. A default occurs if rent remains due for 7 days from the Date of Lease. Upon default, the Lessor may hold Tenant property in lieu of non-payment of rent. If the rent remains unpaid for 30 days from the Date of Lease, the parties shall consider the property located on the premises, abandoned. Lessor may remove property on the premises. Any property so removed shall be the subject of Lessor’s lien, stored and sold within the terms of Wisconsin Statutes, in such cases made and provided.
Assignment and Subordination. The Tenant will not assign this lease or let or sublet the premises or any party thereof without the written consent of the Lessor. This agreement is subject to all present or future mortgages affecting the premises and Tenant hereby appoints Lessor as Attorney-in-Fact to execute and deliver any and all necessary documents to subordinate this agreement to any present or future mortgage affecting the premises.
Insurance. Lessor will provide NO insurance coverage on any property of the Tenant stored on the premises. Insurance on the Tenant’s property is the sole responsibility of Tenant.
Liability of Lessor. Lessor shall not have any liability for and Tenant waives all claims for damage to person or properties sustained by Tenant or Tenant’s employees, agents, invitees, licensees, or any other person resulting from the premises and/or building or any parts thereof of anything adjacent or appurtenant thereto becoming out of repair, or resulting from any accident in or about the premises, building, and/or the underlying real estate.
Rules and Regulations. The Tenant agrees to abide by all of the rules and regulations of Storage52 LLC as may, from time to time be implemented and posted in a conspicuous location at the building. The Tenant acknowledges that violation of the rules and regulations, as well as the above terms of the Lease, are cause for immediate termination of this lease.
The Rules and Regulation shall include, but are not limited to, the following:
a) The Tenant shall obey all lawful orders, rules and regulations of the health officers, health ordinances of the Town, Village, County, and State.
b) Storage of toxic material, waste, or contraband is strictly prohibited.
c) Tenant agrees to disconnect the battery of all property stored on the premises.
d) Tenant agrees to leave keys to ignitions, trailers, or any other keyed equipment available on the premises for Lessor.
